Doctors are routinely denied full payment for their health care services under our state’s workers compensation laws. Many of Mr. Laurent’s clients are experienced in appealing denials of their medical bills to the Texas Workers Compensation Commission Medical Dispute Resolution Division (MDR) and the State Office of Administrative Hearings (SOAH). Oftentimes, however, MDR cases are lost simply because the Doctor has failed to properly ”package” and present his or her MDR appeal in a format consistent with TWCC MDR requirements. Adverse MDR decisions appealed to the State Office of Administrative Hearings are legal in nature and must be tried under the Rules of Civil Procedure before a presiding Administrative Law Judge. With very few exceptions a Doctor’s ability to recover the full amount of his or her medical bill hinges on the doctor’s ability to successfully prove medical necessity before a SOAH Administrative Law Judge.
